BREAKING: Changes to Work Permit Rules for Spouses of International Students in Canada

Canada’s immigration department, IRCC, has recently updated the rules for Spousal Open Work Permits (SOWP), affecting partners of international students studying in Canada.

Starting from March 19, 2024, only spouses or partners of students enrolled in master’s or doctoral programs at Canadian universities or polytechnics are eligible for SOWP. However, exceptions are made for partners of undergraduate students enrolled in specific professional degree programs, such as Doctor of Medicine, Bachelor of Law, or Engineering, among others.

To apply for a SOWP, applicants must demonstrate their relationship with the student and provide evidence of the student’s enrollment in an eligible program. This can include a Letter of Acceptance, proof of enrollment letter, or transcripts.

For those who applied for a SOWP before March 19, eligibility will be determined based on the applicant’s partner having a valid study permit, being eligible for a Post-Graduation Work Permit, and studying full-time at a qualified institution.

Individuals who no longer qualify for a SOWP under the new rules may consider applying for a different type of work permit or a visitor visa. It’s important to note that visitors to Canada are not allowed to work.

The update aims to align with IRCC’s efforts to manage the growth of Canada’s international student program and promote family reunification by allowing spouses to work in Canada while supporting their partners in higher education.
